The information below applies to each company within the ecOnstruction Elemont S.A. group.

1. Personal Data Controller

Depending on which company you contact, enter into a contract with, or maintain business relations with, each company within the ecOnstruction Elemont S.A. group acts as a separate personal data controller (“Controller”, “we”) and independently determines the purposes and methods of processing your personal data.

2. Types of Personal Data

The Controller processes the following categories of personal data:

a) data of individuals contacting the Controller via email or through the Website contact form (identification data, contact details, and any additional information provided in connection with the inquiry);

b) data of individuals included in recruitment documents and collected during the recruitment process (name, contact details, education, professional experience, qualifications, and other information provided during recruitment);

c) data of customers, potential customers, contractors, potential contractors, their representatives, employees, and associates, as well as other individuals whose data is disclosed to the Controller in connection with contract performance (identification data, contact details, data regarding professional authorizations, job positions, and other data provided as part of cooperation).

• entering into and performing contracts;

• contract settlement;

• responding to inquiries or requests and conducting related correspondence;

• the necessity for the performance of a contract or taking steps at your request prior to entering into a contract;

Personal data collected for contract-related purposes will be processed for the duration of the contract or until an objection is raised where processing is based on the Controller’s legitimate interest, unless legal provisions (e.g., tax or accounting laws) require longer processing or unless the data must be retained for the period necessary to defend against potential claims.
Data provided when contacting the Controller will be processed for the time necessary to respond and conduct correspondence, and subsequently until the expiry of the limitation period for potential claims.

7. Recipients of Personal Data

• Personal data may be disclosed to courier service providers, IT service providers, companies supporting the Controller’s IT tools and systems (e.g., software maintenance providers), advisors (e.g., law firms), accounting service providers, audit service providers (e.g., independent auditors), printing, scanning, correspondence, archiving, and document destruction service providers.

• For recruitment processes, personal data may also be shared with entities that support the Controller technically or organizationally in conducting recruitment, including communication with candidates.

1. Types of Personal Data Processed

We process personal data provided to us in your application and data collected during the recruitment process for the purposes necessary to conduct the current recruitment within the ecOnstruction Elemont S.A. group, and—if you provide consent—for future recruitment processes.

Depending on the scope of consent, we may process the following data: identification data, contact details, education history, skills, employment history, professional authorizations, and any other data provided during recruitment.

2. Purpose and Legal Basis

Personal data is processed for the following purposes:

• reviewing applications and conducting the recruitment process, and—where consent is provided—for future recruitment processes;

• defending against potential claims or, where applicable, pursuing claims.

The legal basis for processing includes the necessity to take steps at your request prior to entering into a contract, compliance with legal obligations (including labour law), and, where applicable, your consent (for additional data or future recruitment processes).

3. Retention Period

Personal data will be processed for the duration of the recruitment process, and—if you consent—for future recruitment processes until consent is withdrawn, and thereafter until the expiry of the limitation period for any potential claims, unless legal provisions require longer storage.

V. Your Rights

You have the right to access your personal data; request rectification or restriction of processing; request erasure of personal data; request the transfer of personal data you have provided to the Controller (where processed by automated means and based on consent or a contract); object to processing carried out on the basis of the Controller’s legitimate interests, including processing for marketing purposes; and lodge a complaint with the President of the Personal Data Protection Office.

Where processing is based on consent, you may withdraw your consent at any time without affecting the lawfulness of processing carried out before the withdrawal.
